WHO IS RESPONSIBLE FOR PROCESSING YOUR PERSONAL DATA?

Setpoint/LVS (Setpoint Integrated Solutions, Inc./LVS,19011 Highland Road, Baton Rouge, Louisiana 70809, USA) is the legal entity responsible for all collection and all processing of your personal data in connection with Setpoint/LVS products, services and websites.

Setpoint/LVS is part of Pon Holdings B.V. its affiliates and its subsidiaries (“Pon”). Setpoint/LVS and Pon are committed to respecting and safeguarding your privacy and the security of your personal data you share with us.

WHY DO WE PROCESS YOUR PERSONAL DATA?

Personal data is information that identifies you as an individual or relates to an identifiable individual. When you choose to register your personal data, contact us, visit our websites, or apply to a job posting, we will process some personal data about you. Which personal data we exactly process, depends on which websites, products or services you use. We process the following personal data:

  • Personal data you provide to us: This is the personal data that you may enter when you request or register for training with us, request a quote or other literature from us.  This includes your name, phone number, email address, company or plant name.
  • Geolocation information
  • Online identifiers, such as username and IP address.
  • Usage information, such as how you and your device interact with our website (e.g., the pages you visit, search terms you enter, referring/exit pages, platform type, date/time stamps.)

HOW DO WE SHARE OR TRANSFER YOUR PERSONAL DATA?

You should be aware that Setpoint/LVS is part of a business group within Pon and that departments can be located in Pon companies around the world. As a consequence, your personal data may be shared within and/or transferred to other business group companies or other Pon companies around the world. Setpoint/LVS may share or disclose your information to the following categories of third parties and for the following reasons:

  • To third-party service providers, agents or independent contractors who help us maintain our Services and provide other administrative services to us. (Specifically, these services may include website hosting, data analysis, payment processing, order fulfilment, information technology and related infrastructure provisioning, customer service, email delivery, and auditing.)
  • To unaffiliated third parties whose products and/or services we believe might be of interest to you.
  • We may share your personal information in the course of any reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.

Setpoint/LVS requires the third parties with whom we share or disclose information to diligently process and protect your personal data. 

HOW DO WE PROTECT YOUR PERSONAL DATA?

Setpoint/LVS takes reasonable and appropriate technical and organizational security measures to protect against loss or unlawful processing of personal data and to ensure the security of your personal information. This may include using secure registration forms, encryption of data and restricting access to your personal data. Please understand, however, that no data transmission over the Internet can be guaranteed to be 100% secure.  Consequently, Setpoint/LVS cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk.

If we learn of a security system breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Services or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Services. We may post a notice via our website if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

INTERNATIONAL DATA TRANSFER

Setpoint/LVS is based in the U.S. If you choose to provide us with information, please understand that your personal information may be transferred to the U.S. and that we may transfer that information to our affiliates and subsidiaries or to third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the EU or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal information to the U.S. and other jurisdictions which may not have the same data protection laws as the EU. We retain personal data for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law.

COLLECTION AND USE OF INFORMATION FROM CHILDREN

Our Services are not intended for children. We do not knowingly collect personal information from children, and none of our Services are designed to attract children. In the event that we learn that a person under the age of 13 has provided personal information to us, we will delete such personal information as soon as possible.

OPT-OUT

We provide you the opportunity to opt-out of marketing communications by clicking the “unsubscribe” link in email communications or by contacting us using the contact information provided below. We will endeavour to process your request as soon as possible in accordance with applicable law, but please be aware that in some circumstances you may receive a few more messages until the unsubscribe is processed.  Additionally, we may send you information regarding our Services, such as information about changes to our policies and other notices and disclosures required by law. Generally, users cannot opt-out of these communications, but they will be primarily informative in nature, rather than promotional.

Our website contains links to other sites such as third-party online retailers, advertisers, or unrelated sites that we may link to or web sites that link to our website.  These sites may collect personal information directly from you.
